VERSION 4 Informational 4.6 December 3, 1999 Page 1 of 1 DEPUTY WILDLIFE CONSERVATION OFFICERS It has come to the attention of the Administrative Office of Pennsylvania Courts that there appears to be some confusion concerning whether Act 166 of 1998 prohibits a Deputy Wildlife Conservation Officer from filing a Non-Traffic Citation in the Magisterial District Courts. Please note that this Act amended Title 34 (Game) Section 902 to provide that "deputy wildlife conservation officers shall not be authorized to issue citations or field acknowledgments of guilt for violations and shall provide the information to the wildlife conservation officer." It is our understanding that although this Act prohibits a Deputy Wildlife Conservation Officer from issuing a Non-Traffic Citation, it does not preclude a Deputy Wildlife Conservation Officer from filing a Non-Traffic Citation in the Magisterial District Courts AS LONG AS THE CITATION IS APPROVED BY THE WILDLIFE CONSERVATION OFFICER.
