VERSION 3 MODIFICATION #33 May 12, 1997 Page 1 of 3 ACT 95 OF 1994 - PROCESSING THE POST-DISPOSITION DL-38 In Version 2, Modification #43, dated January 13, 1995, we informed you of changes to the DJS resulting from Act 95 of 1994, which amended section 1533 of the Motor Vehicle Code (Purdon's Title 75) pertaining to license suspension. This Act enables district justices to request license suspension (issue a DL-38) whenever a defendant fails to respond to a citation or summons OR fails to pay fines and costs resulting from any Motor Vehicle violation, excluding parking offenses. We refer to the DL-38 issued for failure to pay fines and costs as the "post-disposition DL-38." Now, you can process post-disposition DL-38s more easily. The new procedures are effective today. The changes we have made are in accordance with the procedures outlined in the District Justice Automated Office Clerical Procedures Manual and in these Modifications. Therefore, for these changes to make processing the post-disposition DL-38 more convenient for you, the correct procedures must be followed. Until now, you needed to access each case to process the post- disposition DL-38. Now, post-disposition DL-38s will appear on the DL-38 to Print Option on the Daily Functions Menu and can be processed from there. In addition, the DL-38 to Print Report now includes post- disposition DL-38s. Consequently, you no longer need to use the Indigency Hearings to Schedule list to determine which cases are eligible for the issuance of a DL-38 for failure to pay. Post-disposition DL-38 defendant copies will appear on the DL-38 to Print List Report and screen. Further, the DL-38s to Print Report has been revised so that the column headings on the report match the headings on the screen. The column headings that now appear on both the DL-38 to Print report and DL-38 to print screen are: DOCKET NO, COPY, DEFENDANT, CHARGE, DISP, CASE BALANCE, EVENT TYPE, EVENT DATE, and DATE ON LIST. The DL-38 Cancellation Notice Report has also been changed. Now, DL-38s that have had only a defendant copy printed will NOT print on the report. In other words, the DL-38 Cancellation Notice Report will only include DL-38s that were sent to PENN DOT. You will see additional questions about your DL-38s when you work with payments and accounting adjustments on a case. When you enter a payment on a case, if an active DL-38 exists, the message will read DO YOU WANT TO TAKE ACTION ON THE ACTIVE DOT DL-38? or DO YOU WANT TO TAKE ACTION ON THE ACTIVE DEF DL-38? If a DL-38 is on the DL-38 to Print Report, the message will read DO YOU WANT TO TAKE ACTION ON THE SCHEDULED DOT DL-38? or DO YOU WANT TO TAKE ACTION ON MODIFICATION #3.33 May 12, 1997 Page 2 of 3 THE SCHEDULED DEF DL-38? Accounting adjustments are also affected by these processing changes. When an earlier payment canceled a DL-38 or DL-38 tickler, voiding or moving a payment now will give you the option to reinstate the DL-38. When you accept a time payment that is less than the full amount of the payment due, and the balance still owed on the payment is applied to the next payment, that part payment will be considered a partial payment, and the DL-38 question will not display. When you see the Active DL-38 question, it will tell you whether the active or scheduled DL-38 is a defendant or PENN-DOT copy. The message that displays on the Case Functions Menu will also differentiate between ACTIVE DOT DL-38s and ACTIVE DEF DL-38s. Printing the DL-38 is easier to process: 1. You can print a pre-disposition PENN-DOT DL-38 copy even when the last Action Code was CNCL(cancel). 2. You are able to print a post-disposition DL-38 PENN-DOTcopy even when the last action was a cancel of the post-disposition DL-38. Before, the only way to print another post- disposition DL-38 PENN-DOT was by starting the entire DL-38 process again. 3. The date of the first valid response (such as scheduling an INHG or making a payment) will be used as the response date on the Suspension Withdrawal form for post-disposition DL-38s. Finally, there has been a change to the error message that displays when you attempt to enter a payment on a pre-disposition traffic case and the PENN-DOT copy of the DL-38 has already been printed. Now, if you attempt to enter a payment on a pre-disposition case where the PENN-DOT copy of the DL-38 has already been printed, the new message, CSE0378 - DL-38 MUST BE CANCELED PRIOR TO ENTERING A PAYMENT, will display. DJS RECEIPT NOW PRINTS MUNICIPALITY CODE Effective today, when fine amounts are payable to a municipality, that municipality's three-digit code will print on the receipt next to MUNICIPAL FINE. The municipality code will also print on receipts that are reprinted. Moreover, the amount on the MUNICIPAL FINE line indicates the amount from that receipt to be paid to the municipality when the monthly reports are run. LANGUAGE ADDED TO DEFENDANT DL-38 FORMS The following language has been added to A638A1-97 and A638A2-97: IF YOUR LICENSE IS SUSPENDED, YOU WILL BE REQUIRED TO PAY ADDITIONAL COSTS TO RESTORE YOUR OPERATING PRIVILEGES. MODIFICATION #3.33 May 12, 1997 Page 3 of 3 PENNDOT ADDRESSES In Modification #3.29 of March 27, 1997, we misstated the new address for the PENNDOT TRANSMISSION EXCEPTION REPORT. The correct address for PENNDOT TRANSMISSION REPORT EXCEPTION is: Department of Transportation, Motor Carrier Division, Forum Place, 555 Walnut St., 7th Floor, Harrisburg, PA 17101. This change of address applies only to the PENNDOT TRANSMISSION REPORT EXCEPTIONS. You should continue to send all other correspondence and forms for PENNDOT to the same addresses you have used in the past.
