It needs to be clarified that the CA17 cost code should be collected only when the district justice accepts guilty pleas to third degree misdemeanors. NEW CAUSE ADDED TO ERROR MESSAGE CSE0028 - INVALID PAYMENT CODE A new reason has been added to the HELP TEXT CAUSE section for error message CSE0028 - INVALID PAYMENT CODE. The new cause is: 4) A nonpayment code is selected, but a payment is required. PUBLIC RESTITUTION CODES WILL PRINT ON WEEKLY REVENUE REPORTS Amounts allocated to Public Restitution print on the Other Receipts Income Report REV-753EX - BROWN that is created when you create your weekly master account check. The public restitution code (PR) will now print next to the money amount on the Other Receipts Income Report REV-753EX - BROWN. RECOMMENDED WARRANT CONTROL GUIDELINES As a reminder, the AOPC recommends that police or other officials in possession of warrants should be notified to make return on the warrants that have not been served. The following time limits are suggested for warrant control purposes: Summary Cases - Outstanding warrants should be returned to the District Justice within 60 days of issuance. Criminal Cases - Outstanding warrants in court cases should be returned to the DJ within 30 days of issuance. The procedures for reissuing warrants can be found in section 11.0-7 of the District Justice Automated Clerical Procedures Manual. NEW VOID REASON CODE ADDED TO ACCOUNTING ADJUSTMENTS As you know, bail (EBL) payments must be voided before bail can be canceled on a case. A new Reason Code has been added to the Accounting Adjustments option on the Case Functions Menu. Use the new code, VEBL (Void Bail Payment), to void bail payments before you cancel bail on a case. MODIFICATION #3.9 October 4, 1996 Page 2 of 2 SUMMARY WARRANTS: A REMINDER In response to recent inquiries regarding warrant processing in summary cases, we would like to remind all district justices of the following information: A warrant may be issued in a summary case as indicated in Rule 75 of the Pennsylvania Rules of Criminal Procedure. This Rule states that a warrant is to be issued when: 1. The defendant has failed to respond to a citation or summons that was served either personally or by certified mail. 2. The citation or summons is returned undeliverable. 3. The district justice has reasonable grounds to believe that the defendant will not obey a summons. In issuing a pre-adjudication warrant, the district justice may indicate the amount of fines and costs due on the face of the warrant. The district justice may also specify an amount of collateral due (not to exceed the total amount of fines and costs), however, the district justice is not required, pursuant to the Rules of Criminal Procedure, to specify either the fines and costs due or a collateral amount. The district justice may issue a warrant with the collateral amount specified, the fines and costs specified, or neither amount specified. Further, Rule 75 indicates that a district justice may issue a post-adjudication warrant under the following circumstances: 1. The defendant has entered a guilty plea by mail and the amount of money forwarded with the plea is less than the amount of fines and costs specified on the summons; or 2. The district justice has found the defendant guilty in absentia and the amount of collateral deposit by the defendant is less than the fines and costs imposed. Because post adjudication warrants are issued for failure to pay an outstanding balance of fines and costs, these warrants should always reflect an outstanding balance of fines and costs. Once a defendant has been arrested pursuant to a warrant in a summary criminal case, the arresting officer and district justice must proceed as specified in Rule 76 of the Pennsylvania Rules of Criminal Procedure.
