VERSION 4 Modification 4.32 January 18, 2001 Page 1 of 1 ORDER IMPOSING SENTENCE FORM The Order Imposing Sentence (AOPC A581) is used to inform a defendant of the sentence that follows a guilty disposition to a summary charge. The new Order Imposing Sentence (AOPC A581A) will print on cases in which a guilty plea is recorded on an M3 charge. This form differs from the Order Imposing Sentence (AOPC A581) used in summary cases because: 1) No trial Is held for M3 cases; 2) There is no collateral amount set on M3 cases; and 3) M3 cases have a 10-day period in which to withdraw a guilty plea, rather than a 30-day appeal period for summary cases. Pursuant to 42 Pa.C.S. § 1515(a)(6), District Justices have jurisdiction to take guilty pleas in some cases in which a defendant has been charged with an M3. Pursuant to Rule 149 of the Rules of Criminal Procedure, in cases in which a defendant pleads guilty before a District Justice to an M3 charge, the defendant has ten days in which to withdraw that guilty plea. Ten days after acceptance of the guilty plea and the imposition of sentence, the District Justice is required to certify the judgment and forward the case to the clerk of court. The original Order Imposing Sentence (AOPC A581) will continue to print for summary cases. The Order Imposing Sentence prints from the Disposition and Sentencing screen when you press . The form will not print for dispositions of NG (Not Guilty), WD (Withdrawn), or DIS (Dismissed).
