VERSION 4 Modification 8 November 24, 1999 Page 1 of 2 INSERT THIS MODIFICATION BETWEEN THE FOLLOWING PAGES: L24 and L25, TRAFFIC/NON-TRAFFIC MANUAL, CASE STATUS CHAPTER NEW TRUANCY REFERRAL FORM When a child age thirteen (13) years or older is charged with a violation of the compulsory school attendance statute (24 P.S. Section 13-1327), he/she can be convicted of this truancy offense if the parent, guardian or person in parental relation took every reasonable step to ensure attendance of the child at school. (See 24 P.S. Section 13- 1333(b)(1). Upon conviction for this offense, the child may be sentenced to pay a fine or shall be assigned to an adjudication alternative program. (See 24 P.S. Section 13- 1333(b)(1). If the child fails to pay the fine or to comply with the adjudication alternative program, the District Justice can either certify the child to the Court of Common Pleas (See 42 Pa.C.S.A. Section 6302) or allege that the child is dependent (See 24 P.S. Section 13-1333(b)(2)). A new form, Truancy Referral (AOPC 608B) has been created to be used when the District Justice alleges that the child is dependent. The Juvenile Certification option on the Case Status Menu within a case has been renamed Juvenile Certification/Truancy Referral. A new action code, TRF (Truancy Referral), has been added to the Juvenile Certification/Referral screen. Truancy Referral Form (AOPC 608B) prints when you select the new Action Code of TRF. In addition, the Action Code CNCL that appears in the pop-up window on the Juvenile Certification/Truancy Referral screen has been renamed CANCEL JUV CERT/REFERRAL. The Name Type for Children and Youth Services is CYS. The Name ID is CYS-XX, where the Xs represent the first two digits of your District Court number. If you do not maintain a Children and Youth Services agency before you use the new option within a case, the form will be addressed to the county Clerk of Courts as a default.
